FIGHT AGAINST PIRACY AND COUNTERFEITING
POLICY ON INTELLECTUAL PROPERTY AND OTHER RIGHTS

PREAMBLE
The website www.megascope.fr, published by MK2 VILLETTE, simplified joint-stock company – Paris Trade and Companies Register No. 538 675 372 – registered office: 55 rue Traversière, 75012 Paris – share capital: 494,000.00 euros – intra-community VAT number: FR17538675372 (hereinafter “MK2”) (hereinafter “the Site”), is an online platform allowing professionals (cinema theaters, associations, cultural institutions…) to broadcast audiovisual content offered in our database and hereinafter referred to as the “Content” to their audiences.
This policy, whose provisions are recalled in the Site’s Terms of Use and Terms of Sale (hereinafter referred to and available respectively at the following addresses:

aims to inform Users:
i) of their obligations;
ii) of the measures taken by MK2 to protect the Content.
Any use of the Site implies unconditional acceptance and compliance with this policy.
ARTICLE 1 – INTELLECTUAL PROPERTY AND CONTENT PROTECTION
The Site, as well as all elements of any kind it may contain (notably the Content, texts, graphics, posters, videos, sound content, images, logos, trademarks, various creations, software, databases, etc.), are protected or may be protected by rights, notably intellectual property rights or other rights, belonging to MK2 and/or third parties.
The use of any feature of the Site and, more generally, its browsing, does not imply or grant any authorization or any transfer, partial or total, tacit or not, of any kind whatsoever, related to the Site, its elements, and the rights attached thereto.
It is reminded that the Content may be protected by national and international provisions, notably but not exclusively in terms of copyright and related rights, and is exclusively reserved for use in accordance with the Site’s TOU and TOS.
The Content may be equipped with technical protection measures. Digital Rights Management (DRM) systems allow controlling the use made of digital works, while offering the User maximum flexibility in their viewing and protecting rights holders.
The User agrees not to circumvent or damage the digital file protection systems necessary for the use of the Services, nor to attempt to do so, nor to encourage third parties to perform or attempt such acts.
Any use, in any way whatsoever, of all or part of the Site, its elements, the Content or software, outside the strictly defined framework of the TOU and TOS, and notably any reproduction, distribution, display, communication, modification, adaptation, sale, exchange, rental, recording (including by screenshot or video capture), storage or archiving, by any means or process whatsoever, constitutes an infringement of rights.
Such infringement may result in the immediate suspension or termination of the User’s Account by MK2, without any possibility of refund of orders, as well as engage the civil and/or criminal liability of the User, and expose them to all appropriate actions, notably payment of damages and legal and criminal proceedings.
The Site may contain hyperlinks allowing access to websites not published by MK2. MK2 exercises no control over the content of these sites and disclaims all responsibility, notably regarding their content.
ARTICLE 2 – BROADCASTING RIGHTS AND FIGHT AGAINST PIRACY
2.1. Scope of granted rights
In accordance with the TOS, the User who places an order on the Site benefits only from the rights summarized in their contract (as defined in article 2.2 of the TOS), namely:
– for the selected broadcasting mode (commercial or non-commercial broadcast);
– on a non-exclusive basis;
– at the Client’s broadcasting location(s);
– for the broadcasting period and number of screenings specified at the time of order;
– exclusively and mandatorily using the Equipment delivered by MK2 (as defined in article 1.3 of the TOS).
All other rights on the Content and Equipment are strictly reserved to MK2 and/or its rights holders. Any use exceeding or violating these rights is strictly prohibited and may constitute an act of counterfeiting.
2.2. User obligations regarding piracy prevention
The User takes all necessary precautions to avoid any risk of piracy of the ordered Content.
In this respect, the User:
i) is prohibited from transferring the links of the broadcasting Equipment and/or marketing Equipment to anyone other than their employees responsible for technical broadcasting and Content promotion, and undertakes to enforce this prohibition with them;
ii) undertakes to remind their audience, before any screening, that any total or partial recording of a cinematographic or audiovisual work constitutes an act of counterfeiting strictly prohibited, and to effectively ensure that no recording takes place during the screening.
The User undertakes in particular to implement any appropriate measure, notably by clear and legible display, projected for a sufficient duration just before any broadcast, reminding the public that:
– piracy is a criminal offense;
– the private copy exception does not apply;
– article L.335-3 of the Intellectual Property Code states that:
“Any total or partial recording of a cinematographic or audiovisual work in a cinema theater is also an act of counterfeiting.”
ARTICLE 3 – REPORTING VIOLATIONS
In case of detection of a violation or suspicion of fraudulent use of Content or any other element of the Site, the User immediately undertakes all measures they can implement and sends without delay a precise report, accompanied by all useful explanations, to the following address:
ARTICLE 4 – APPLICABLE LAW AND COMPETENT JURISDICTION
This policy is subject to French law.
Any dispute relating to its application, interpretation or execution will be subject to the exclusive jurisdiction of the courts of Paris (France).
For Cinema Operators - Commercial Screening
To create your custom screening, simply provide us with the following details before finalizing your order:
- Your legal status (operator)
- The desired equipment
- The screening period and your audience
- The delivery location(s)
- Options to enhance your screenings
Once we receive this information, we will send you a link to download all the necessary files as well as the associated KDMs.

If you are not responsible for the payment, please provide the full contact details of the third-party payer in the order notes.
